Terms and
Conditions:
1. We will only agree to sell domains if we
regard them as 'premium' domains
2. The standard term of the sales agreement is 12 months, both
parties may agree to extend or reduce this term
3. We will only sell Australian .com.au or .net.au domains
4. We will only sell domains if we are in agreeance with the seller
on their 'realistic' target price
5. The agreed target price is a legally binding agreement to sell,
but may be varied from time to time upon agreement
6. Any offer received below the agreed target price will only be
legally binding if the seller indicates acceptance.
7. Domains for sale must be fully managed by
us, under our full control at our preferred registrar - note the
domains will always remain registered to the seller, however the
seller will not have access to the domain password until the term of
the agreement is completed - this allows us to offer potential
buyers an assurance that they will be protected if they meet the
target price (or an accepted lower price) to make it easier to sell the domain
at the best possible price
9. Exclusivity - commission fees are payable upon sale of the domain
by
any means during the sale period
10. We reserve the right to use any means at our disposal to sell the
domain at the highest possible price
11. No commissions or ongoing fees are payable until sold
12. During the sales period the domains may be 'parked' on a web
page that may include relevant advertising - any pay-per-click
revenue generated during the sales period from the web page will be
allocated to our account.
13. We accept no liability for loss if the buyer does not proceed
with the transaction after making an agreed offer.
WHY WILL THIS PACKAGE ATTRACT BUYERS?
The buyer gains protection from the possibility of being
'gazumped' as we retain full password control over the domain
registry records during the sale period. The buyer can be assured
that once they meet the 'target price' the transaction will proceed.
By
paying us (instead of the seller directly) the buyer knows their
money will not be in the hands of the seller until full transfer of
registration has been effected.
The
buyer can also benefit from our registrant transfer service, without
the need to engage a domain reseller or solicitor.
Less risk to the buyer and an easy transfer simply means more chance of a
higher sale!
WHY IS THIS PACKAGE ATTRACTIVE TO THE SELLER?
In a nutshell, because it is attractive to the buyer!
In a direct sale, the seller would need to convince the potential
buyer that they are 'honest', expecting them to just transfer their
payment - sometimes thousands of dollars - and then hope they
proceeed with their end of the deal. Alternatively both parties
would need to engage solicitors, unnecessarity dragging out the
simple registrant transfer process and costing both parties extra. The
buyer or seller would also need to understand the jargon to
correctly effect the transfer of registrant.
A
sale is much riskier to both parties in a direct transfer arrangement.
This
package passes all the marketing, domain transfer
and money transfer responsibilities over to us, protecting both parties in
the process.
